Pa. State Educ. Ass’n v. Pub. Sch. Employees’ Ret. Bd., 2024 Pa. LEXIS 421 (S. Ct. March 21, 2024) (Wecht, J.).

This case finds that the PSEA has standing as an organization to challenge the determination of a state agency concerning that which may affect collective bargaining. The Pennsylvania State Education Association brought an action against Public School Employees’ Retirement Board, challenging a resolution in which PSERB addressed the matter on which it intended to apply a statute, which states an approach that PSEA believes to be impermissible. The Commonwealth Court dismissed PSEA for lack of standing. The Supreme Court said that the PSEA did have standing.
